Managing Communications During an Internal Investigation

This holds especially true for an organization in the throes of an internal investigation, when, in addition to tough decisions about how to appropriately investigate and resolve a matter, legal and HR teams are facing rumor mills, questions and scrutiny from other staff members, board members, media and customers. From employees, shareholders and boards of directors to the media and online trolls, the task of managing the internal and external communications during an investigation can be daunting. This panel will use real life examples of companies that have navigated these challenges well, avoiding undue reputational harm and litigation in the process, and those that have fallen short and suffered the consequences. This panel will outline best practices for communicating during and after an investigation and how to avoid common pitfalls when faced with an internal crisis, as well as legal parameters for what can be said, and confidentiality and privilege considerations.

Prevention Strategies to Keep Your Company Out of Wage & Hour Trouble

They will also learn about timecard requirements, how to minimize off-the-clock violations and primary risk factors. Implement written policies regarding pre/post shift work, as well as active management of such work. Eliminating rounding time punches. Have a process for time punch edits. Provide management training. Implement timecard audits to ensure compliance. And implement an attestation. Overtime calculation errors – exempt vs non- exempt employees. Learn about commissions/non-discretionary bonuses and regular rate. Overtime rules in California. Minimize exposure of OT miscalculations. Another topic that will be discussed is paystub compliance and the problems businesses are having with paystub compliance. Arbitration agreement mistakes is another topic that will be discussed. Poor document handling practices, no class action waiver, electronic onboarding without proof that an employee acknowledged and agreed to an arbitration are issues that will be discussed. The last topic will be compliance self-audits. What is an internal wage and hour audit? How does it help? Discovering problems on your own terms versus in response to a discovery demand.

When No Witnesses Are Around: Tips for Assessing Credibility

HR Compliance Track Presenter at CAHR19You just completed your last investigation interview. Now comes the hard part: assessing credibility. Sometimes the facts and credibility of the complainant, subject and witnesses is clear. But often, the investigator finds it’s a close call as to who is more credible, or finds that both parties and witnesses are credible. Giving up and saying “inconclusive” is not an option: the investigator must reach a conclusion. Credibility assessments are imperative in helping the investigator determine which testimony and evidence is more credible. Gain insights from an experienced attorney investigator how to effectively assess credibility using factors such as plausibility, prior record, corroboration, consistency or motive. In this #MeToo and #TimesUp era, employers must confidently rely on investigation findings that are based on credibility assessments in order to support their employment decisions.

Veterans In The Workplace: A Primer On Military and Veteran Workplace Issue

Developing Talent that Can Lead Innovation and Digital Transformation

Presented by Linda A. Hill, Ph.D.

Based on her research of innovative organizations in general, and of those undergoing digital transformation in particular, Professor Linda Hill will discuss how the second imperative of leadership—managing your network—is too often neglected at an organization’s peril. Hill will provide examples of what companies are doing to develop leaders who are both value creators and game changers because they know how to build ecosystems of partners inside and outside the organization required to implement innovative solutions.

Meet Professor Hill

Linda A. Hill is the Wallace Brett Donham Professor of Business Administration at the Harvard Business School and chair of the Leadership Initiative. Hill is regarded as one of the top experts on leadership. Hill is the co-author of Collective Genius: The Art and Practice of Leading Innovation, co-founder of Paradox Strategies, and co-creator of the Innovation Quotient. She was named by Thinkers50 as one of the top ten management thinkers in the world in 2013 and received the Thinkers50 Innovation Award in 2015.

Hill’s research focuses on implementing global strategies and leading innovation; building innovative organizations and ecosystems; developing leaders for innovation; and the role of the board in governing innovation. She is the author of highly-regarded books and articles on leadership, including her latest book Collective Genius: The Art and Practice of Leading Innovation (Harvard Business Review Press 2014). Collective Genius was named by Business Insider as one of “The 20 Best Business Books” in 2014 and received the Gold Medal for Leadership, Axiom Business Book Award. In 2015, Hill, along with her co-authors, received the first Warren Bennis Prize for the Harvard Business Review article “Collective Genius,” based on the book.

Hill is also the co-author of Being the Boss: The 3 Imperatives of Becoming a Great Leader, noted by the Wall Street Journal as one of the “Five Business Books to Read for your Career in 2011” and author of Becoming a Manager: How New Mangers Master the Challenges of Leadership (2nd edition). Her books are available in multiple languages. Hill has authored or co-authored numerous Harvard Business Review articles, including “Where Will We Find Tomorrow’s Leaders,” “Winning the Race for Talent in Emerging Markets,” and “Are You a High Potential?” She is a contributor to the HBS Press Pocket Mentor series Managing Up, Hiring, Becoming a New Manager, and Negotiating Outcomes.

Hill has chaired numerous HBS Executive Education programs, including the Young Presidents’ Organization Presidents’ Seminar and the High Potentials Leadership Program, and Leading and Building a Culture of Innovation. She was course-head during the development of the new Leadership and Organizational Behavior MBA required course.

Hill has been at the forefront of developing various innovative learning programs for managers, including Breakthrough Leadership, the winner of the 2013 Brandon Hall Group Award for Best Advance in Unique Learning Technology, and the award-winning multimedia management development programs such as High Performance Management.

Hill’s consulting and executive education activities have been in the areas of leadership development, talent management, leading change and innovation, implementing global strategies, and managing cross-organizational relationships. Organizations with which Professor Hill has worked include the Abu Dhabi Investment Authority, General Electric, RELX, Accenture, UnitedHealth Group, IBM, MasterCard, Merck, Mitsubishi, Morgan Stanley,
National Bank of Kuwait, AREVA, The Economist, Salesforce.com, and The World Economic Forum. In 2014, Hill co-founded Paradox Strategies, an advisory and research firm that assesses and advises organizations and boards on leadership and innovation.

Hill is a member of the Board of Directors of Relay Therapeutics, Harvard Business Publishing, and the Global Citizens Initiative, Inc. Hill serves on the Board of Trustee of the Art College of Design and is a Special Representative to the Board of Trustees of Bryn Mawr College. She is also on the Advisory Board of Eight Inc., the Aspen Institute Business and Society Program, and the Advisory Board for the California Institute for Telecommunications and information Technology (Calit2). She is on the Board of Advisors of the American Repertory Theater. She is a member of the HR People + Strategy Advisory Council. Hill is a former director of the Eaton Corporation, former member of the Board of Trustees of The Rockefeller Foundation, The Bridgespan Group, State Street Corporation, and a former member of the Nelson Mandela Children’s Fund USA board.

Hill completed a post-doctoral research fellowship at the Harvard Business School and earned a Ph.D. in Behavioral Sciences at the University of Chicago. She received her M.A. in Educational Psychology from the University of Chicago. She has a B.A., summa cum laude, in psychology from Bryn Mawr College.

The California HR Conference allows me to feel more connected to the HR community as a whole, which is especially important when you work as an HR department as one. 

Through the conference, I’ve made professional and personal connections that will stay with me forever. Last year I was considering new opportunities and mentioned this to a vendor that I’d never met before. He asked a few key questions about what I was looking for, and then took me around the exhibit hall introducing me to tons of other vendors who may have connections that could land me a dream job. My networking tip? Many vendors have cool events and parties in the evening that you’ll miss out on if you don’t stop and say hi to everyone at the Expo!

I always arrive early to network with other “early birds.” I never miss an opportunity at lunch to network with as many folks as I can. I might be a little different in that I typically don’t look for old friends, but look to find new ones at lunch.

The proliferation of computers, PDAs, other electronic devices, and telecommuting means that work follows you everywhere. This creates numerous complexities with respect to employment law compliance. Companies need to worry about how to compensate non-exempt employees who work outside the office. What happens when a non-exempt employee checks email for two minutes on an iPhone over the weekend? Because of the mass use of PDAs, companies always expect employees to be available. When must an employer compensate an employee for on-call time? Do employers need to reimburse employees for the cost of their PDAs and monthly bills? Cell phone use on the road raises separate risks. What happens if an employee gets in an accident while talking on a cell phone? Who is liable? Finally, telecommuting raises its own set of separate issues. A study conducted by the U.S. Commission on Civil Rights revealed that virtually all transgender employees experience harassment or mistreatment on the job. The study also showed that many transgender employees were forced to use restrooms that did not match their gender identity, were told to dress and act like a different gender than their own or they would lose their job, or had their private information divulged without permission.
